This Acceptable Use Policy ("AUP") applies to everyone who uses SimpleGPS (https://www.simple-gps.com). Breaching it may lead to suspension or termination.
You must not
- Break the law or infringe others' rights (including IP and privacy).
- Upload malware, or attempt to gain unauthorised access to the Service, other Workspaces or our infrastructure.
- Probe, scan or test the vulnerability of the Service without our written permission, or circumvent authentication, rate limits or tenant isolation.
- Use the Service to store or transmit unlawful, defamatory, or harmful content.
- Track individuals without a lawful basis (e.g. employee vehicles without informing the driver, or any vehicle you do not have authority over).
- Send spam or harvest data about other users.
- Overload or disrupt the Service (e.g. denial-of-service, excessive automated requests).
- Resell or provide the Service to third parties except as permitted by your plan.
If somebody is tracking you
If you believe a SimpleGPS device is following you without your consent, tell us at https://www.simple-gps.com/privacy/abuse. You do not need an account, a person reads it, and we do not tell the account holder that you contacted us. Any demand for it is reviewed, and we disclose only what the law requires - a court can compel disclosure - and if that ever happens we will tell you wherever the law allows. The form asks how we can reach you safely, and we use only that.
Two different things follow, and we keep them apart on purpose:
- On a credible report we may suspend the service, stop location sharing and disable the device without notifying the account holder first. A suspension is reversible and does not retire the SIM, and a wrongful one is restored with the time credited - but it still matters, for instance to an owner whose vehicle is stolen while it is off, which is why a person decides and the decision has a deadline.
- We hand somebody else's location history to a third party only on valid legal process - a court order, a warrant, or a lawful request we are obliged to answer. The cost of being wrong here is telling somebody where another person has been, so a report alone is not enough. This does not apply to your own data: a verified person asking what we hold about them is answered through https://www.simple-gps.com/privacy/access.
If we suspend an account
A suspension has a way back, and a deadline. We aim to decide within five business days and to tell you either way. We restore the service only on a written determination, made by us and kept on file, that restoring this specific access is lawful, and never while a protective order or a credible safety concern stands - those checks can take longer than five days. If the report is not made out, the service is restored and the time lost is credited. If unauthorised tracking is confirmed, we terminate the account and refund the unused full months of the period already paid - a suspension is not a way for us to keep both the service and the money.
We tell the account holder that the account is suspended, once doing so is safe. We do not tell them who reported it, and we pass on nothing that would identify that person. Any demand for it is reviewed, and we disclose only what the law requires - a court can compel disclosure - and if that ever happens we will tell the reporter wherever the law allows.
We are not an emergency service. If you are in danger, contact your local emergency services first.
Security research
If you believe you have found a vulnerability, please report it to [email protected] rather than exploiting it. We will not pursue good-faith research that respects this AUP.
Enforcement
We may investigate suspected violations and cooperate with law enforcement. We may remove content or suspend access to protect the Service and its users.
